Terms of Service
These Terms of Service ("Agreement") govern the services provided by PHOTO RUMBA BOOTH ("Vendor") to its clients ("Client") who engage the Vendor through https://www.photorumbabooth.com ("Website").
1. Booking & Payment Terms
Retainer: A 50% non-refundable retainer and a signed client agreement are required to secure your booking date.
Final Payment: The remaining 50% balance is due prior to the start of the event on the event date.
Payment Methods: Payment can be made via credit card (online), cash, or cheque.
2. Insurance
PHOTO RUMBA BOOTH is fully insured with $2,000,000 in aggregate liability coverage. Upon request, we can provide a Certificate of Insurance and list your venue as an additional insured.
3. Exclusivity
Client agrees that PHOTO RUMBA BOOTH is the exclusive provider of photo booth services for the event. No other individual or entity may provide similar services during the contracted event time without written approval.
4. Force Majeure / Unforeseen Events
The Vendor is not liable for cancellations or service interruptions due to events beyond our control, including but not limited to:
Acts of God
Natural disasters
Government mandates (e.g., states of emergency)
Accidents, illness, or other unforeseen personal circumstances
In such cases, PHOTO RUMBA BOOTH will attempt to provide a suitable substitute at no additional cost to the Client.
5. Limitation of Liability
Vendor is solely responsible for the services directly provided. We are not liable for the actions or failures of third-party vendors or for consequential damages of any kind.
6. Cancellation Policy
If Client cancels the event, no fees are refundable.
Cancellations made less than 6 months before the event require full payment due to loss of opportunity and preparation time.
7. Postponement Policy
If the event is postponed, all services will pause upon notification.
A new date must be confirmed to resume services.
A revised payment schedule will be provided.
If services must resume after a new date is confirmed, the second payment (final 50%) becomes due at that time.
8. Copyright & Usage
All content, images, and materials created during the event are the exclusive intellectual property of PHOTO RUMBA BOOTH, in accordance with Canadaโs Copyright Act (R.S.C., 1985, c. C-42).
Client License: PHOTO RUMBA BOOTH grants Client a non-exclusive, personal-use license to display or share digital photos:
On personal social media accounts
In scrapbooks or personal gifts
In non-commercial email, newsletters, or holiday cards
9. Care of Property / Damages
Client agrees to care for all rented equipment and accessories.
Client is financially responsible for lost or damaged items, up to full replacement value.
Payment for damages is due within 5 business days of the event.
10. Protection of Equipment (Outdoor Events)
Clients may not move or unplug the photo booth or any equipment.
If the booth is outdoors, the Client must provide adequate cover in case of rain, hail, or lightning.
If PHOTO RUMBA BOOTH must relocate the booth indoors due to unsafe weather conditions after setup, a $100 relocation fee applies.
11. Safe Working Environment
Clients agree to maintain a safe, respectful, and professional environment for all PHOTO RUMBA BOOTH staff and equipment.
If any Vendor staff member or bystander feels threatened or unsafe, we reserve the right to terminate services immediately with no refund.
Clients agree to hold the Vendor harmless for any resulting service interruptions.
12. Entire Agreement
This Agreement represents the entire understanding between the Client and PHOTO RUMBA BOOTH. All changes or additions must be made in writing and signed by both parties.

Acknowledgment
By booking services with PHOTO RUMBA BOOTH, the Client acknowledges that they have read, understood, and agree to be bound by these Terms of Service.
